DGCA Proposes Tougher Rules for Foreign Airlines: Digital Registration and Local Accountability

India’s aviation regulator, Directorate General of Civil Aviation (DGCA), has proposed a new set of rules aimed at strengthening oversight of foreign airlines operating in the country. The draft framework introduces mandatory digital registration, stricter compliance requirements, and clearer accountability for airlines’ local representatives in India.

The proposed regulations are part of the regulator’s effort to modernize aviation governance and improve transparency in the functioning of international carriers.

Digital Compliance Through eGCA Portal

A key component of the proposal is the shift toward a digital compliance system using the eGovernance of Civil Aviation (eGCA) portal.

Under the draft guidelines, foreign airlines will be required to complete their registration through the portal and obtain unique login credentials. To access the system, airlines must submit verified documentation related to their corporate incorporation and operational approvals.

Access will only be granted after the regulator verifies the authenticity of these documents and evaluates the competence of the airline’s designated local representative.

Mandatory Local Representative in India

The proposal requires every foreign airline operating in India to appoint a local representative responsible for regulatory compliance.

This representative must either be an Indian citizen or a registered Indian entity. Their role will include coordinating with authorities, ensuring that all regulatory requirements are met, and maintaining updated operational information on the eGCA platform.

The airline will remain legally responsible for any compliance failure linked to its appointed representative.

Strict Reporting and Operational Compliance

The draft rules also introduce tighter reporting obligations. If an aviation incident occurs, the airline’s local representative will be required to notify the Directorate General of Civil Aviation within four hours.

In addition, the proposal introduces a concept called “deemed suspension.” Under this provision, if an airline receives approval to operate flights to specific airports but fails to utilize the slots for four consecutive seasons defined by the International Air Transport Association (IATA), the authorization may automatically be suspended.

Passenger Complaint Mechanism

Another important feature of the proposal is the introduction of a structured passenger grievance redress system for foreign carriers.

Airlines will be required to maintain a formal complaint register and submit periodic reports to the aviation regulator. This system aims to strengthen consumer protection and ensure greater transparency in handling passenger grievances.
